Board Rental Agreement Terms
Introduction
This Surfboard Rental Agreement ("Agreement") is made between Ocean Fly Nicaragua ("Lessor") and the customer ("Lessee") who completes the online booking process. By renting a surfboard from Ocean Fly Nicaragua, the Lessee agrees to the following terms and conditions:
Rental Terms
Rental Period: The rental period commences at the time the surfboard is rented and ends at the agreed-upon return time. Late returns may incur additional charges.
Rental Fees: Rental fees are payable in advance. The fees vary based on the type of surfboard and the rental duration. All fees are detailed on our website.
Deposit: A deposit is required for each surfboard rental. The deposit amount is specified at the time of rental. The deposit will be refunded upon the return of the surfboard in satisfactory condition, minus any applicable fees for damages or loss.
Condition of Equipment
Inspection: The Lessee agrees to inspect the surfboard before use and acknowledges that it is in good condition and suitable for the intended purpose. Any pre-existing damage must be reported to Ocean Fly Nicaragua prior to use. For boards that are delivered to your accomodation before your arrival, the delivery company will take photos to document the condition of the board when they drop it off.
Use of Equipment: The Lessee agrees to use the surfboard responsibly and follow all safety guidelines. The surfboard should only be used in appropriate surf conditions.
Damage and Loss
Damage Fees: The Lessee is responsible for any damage that occurs during the rental period. Any damage will be assessed on an individual basis, but as a guideline the following fees will be assessed:
Premium Boards:
Small ding: $50
Large ding: $100
Standard Boards:
Small ding: $25
Large ding: $50
The rental category of the board is included in the board description on the online rental shop.
Loss or Theft: In the event the surfboard is lost or stolen, the entire deposit will be forfeited.
Snapped Boards: If the surfboard is snapped, the entire deposit will be forfeited.
Return of Equipment
Return Condition: The surfboard must be returned in the same condition as it was rented, aside from normal wear and tear. Ocean Fly Nicaragua will inspect the surfboard upon return to assess any damage.
Cleaning: The surfboard should be rinsed with fresh water and free of sand or debris upon return.
Late Returns: Surfboards returned past the agreed-upon time may incur additional rental charges.
Liability and Indemnity
Assumption of Risk: The Lessee acknowledges that surfing involves inherent risks and assumes all risks associated with the use of the rented surfboard.
Indemnification: The Lessee agrees to indemnify and hold harmless Ocean Fly Nicaragua from any and all claims, damages, liabilities, and expenses arising from the Lessee's use of the surfboard.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Nicaragua. Any disputes arising from this Agreement shall be resolved in the courts of Nicaragua.
Acknowledgment
By completing the online booking process, the Lessee acknowledges that they have read, understood, and agree to all terms and conditions outlined in this Agreement.
